1Acceptance of Terms

These Terms of Service ('Terms') govern your access to and use of the Makarena V2 platform, including all web, mobile, and API interfaces (collectively, the 'Service'). By accessing or using the Service, you confirm that you are at least 13 years old, have the legal capacity to enter into a binding agreement, and accept these Terms in full.

2Service Description

Makarena V2 provides a communication platform featuring:

• Peer-to-peer video and audio calling via WebRTC
• In-call text chat with AI-powered real-time translation
• AI speech-to-text transcription and text-to-speech (TTS) voice dubbing
• Contact management, call history, and transcription records
• Progressive Web App (PWA) installable on any compatible device

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

3Accounts & Eligibility

To use most features of Makarena V2, you must register for an account. You agree to:

• Provide accurate, current, and complete registration information
• Keep your password secure and not share it with others
• Notify us immediately of any unauthorised access to your account
• Be responsible for all activity that occurs under your account

You must be at least 13 years of age to use Makarena V2. Accounts of minors under 13 will be terminated without notice.

4Acceptable Use

You agree to use Makarena V2 only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

• Use the Service to harass, threaten, defame, or harm any person
• Transmit spam, malware, viruses, or any malicious code
• Attempt to gain unauthorised access to other users' accounts or our systems
• Use automated scripts, bots, or scrapers against the Service
• Resell or sublicense access to the Service without written consent
• Violate any applicable local, national, or international law or regulation
• Use AI features to process content that is unlawful, harmful, or violates OpenAI's usage policies

We reserve the right to suspend or terminate accounts that violate these conditions.

5Billing & Credits

Video calls are always free. AI features (speech transcription, translation, voice dubbing) consume credits billed at $0.001 per credit, charged weekly.

• Speech-to-Text: 1 credit per 10 seconds of transcription
• Translation: 1 credit per ~1,600 tokens
• Voice Dubbing (TTS): 1 credit per ~19 characters

Usage is tracked and you can monitor your balance in the billing section. We will notify you when your balance falls below a configurable threshold. You authorise us to charge your payment method for any outstanding credits consumed.

All charges are non-refundable except where required by applicable law or at our sole discretion.

6Intellectual Property

All content, design, code, trademarks, and materials comprising the Makarena V2 Service are owned by or licensed to Makarena V2 and are protected by applicable intellectual property laws.

You retain ownership of any content you create or transmit through the Service (such as chat messages). By using Makarena V2, you grant us a limited, non-exclusive licence to process that content solely to deliver the Service features you have requested (e.g., translating a message you send).

7AI Services & Third-Party Providers

AI features are powered by third-party providers including OpenAI. By using transcription, translation, or TTS features, your content is transmitted to these providers' APIs in accordance with their data processing agreements and usage policies. You agree not to transmit content that violates those policies.

AI-generated output (transcriptions, translations) may not always be accurate. You should not rely on these outputs for critical or safety-sensitive decisions.

8Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or fully accurate.

To the maximum extent permitted by law, Makarena V2 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

Our total liability to you for any claim arising from the Service shall not exceed the amount you paid us in the 3 months preceding the claim, or €10, whichever is greater.

9Termination

You may delete your account at any time from your profile settings. We reserve the right to suspend or terminate your account immediately and without notice if you violate these Terms, engage in fraudulent activity, or if required by law.

Upon termination, your right to use the Service ceases immediately. Any outstanding unpaid credits will remain due. Provisions of these Terms that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.

10Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the relevant courts.

11Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a notice in the application. The updated Terms will be effective from the 'Last updated' date shown at the top of this page. Continued use of Makarena V2 after that date constitutes acceptance of the revised Terms.
